General Terms and Conditions of KletterRetter GmbH for Consumers

1. Scope
These General Terms and Conditions apply to all contracts concluded between KletterRetter GmbH and consumers within the meaning of Section 13 of the German Civil Code (BGB) via our online shop.

2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

The customer submits a binding offer by completing the ordering process and activating the corresponding button. This applies both to the regular checkout process and to the use of express payment services such as PayPal, Google Pay, Link or comparable payment methods.

The contract is concluded upon our explicit order confirmation or dispatch of the goods. An automatically generated order confirmation does not constitute acceptance of the contract.

3. Storage of Contract Text
The contract text is stored by us. The order details and these Terms and Conditions are sent to the customer by email.

4. Prices, Shipping Costs, Withdrawal
All prices are final prices and include statutory value added tax.

In the event of withdrawal, the customer bears the direct costs of returning the goods.

5. Delivery
Delivery times are specified in the respective product description. If a product is unavailable, we will inform the customer without delay. Any payments already made will be refunded.

6. Payment Terms
Available payment methods are displayed during the ordering process. The invoice amount is due immediately upon conclusion of the contract unless another payment period has been agreed. We reserve the right to exclude certain payment methods. When using external payment service providers, their terms and conditions apply in addition.

7. Warranty
Statutory warranty rights apply.

8. Liability
We are liable without limitation for intent and gross negligence. In cases of slight negligence involving a breach of essential contractual obligations, liability is limited to foreseeable damages typical for the contract. Liability for damages resulting from injury to life, body or health remains unaffected.

10. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution:

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Applicable Law
German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.
